These terms and conditions govern the use of the website paliva.org and ordering songs, poems and personal intros from Paliva. Please read them before you create a profile or send an order — by doing so you accept them. If you have a question, write to us at info@paliva.org.
Scope and definitions
These terms apply to every visitor of the site, and the sections on orders also apply to everyone who orders a piece. What is written in the offer for a specific order (price, delivery time, what you receive) takes precedence over these general terms, without limiting your statutory rights.
In these terms:
- “Paliva” (“we”) is the trader named in the section “Who provides the services”.
- “The site” is paliva.org with all its pages.
- A “visitor” is anyone who uses the site — with or without a profile.
- The “client” (“you”) is the person who sends an order and enters into a contract with Paliva.
- The “recipient” is the person the piece is for, when it is a gift.
- A “piece” is the song, poem or personal intro created on request, together with its lyrics or text, files and versions.
- The “offer” is the email in which Paliva replies to the order and states what it will create, the price, the delivery time and the terms.
- A “personal link” is the address of a private page on the site through which you may receive the piece.
Who provides the services
The site and the services are provided by:
- Trader
- Paliva
- info@paliva.org
Write to us at info@paliva.org — for orders, questions, complaints and reports about content.
Using the site
The site is free. You can listen to and read the pieces, look at the prices and write to us without a profile.
Use the site only lawfully: no attempts at unauthorised access, automated collection of content, overloading the site or getting around its limits and protections.
We do our best to keep the site running without interruption, but we cannot guarantee it: it may be temporarily unavailable because of maintenance, updates or a problem at one of our providers. We may change, add and remove pages and features.
Profile and comments
A profile is optional. With it you see your orders and requests, like pieces, make playlists and write comments. By creating a profile you accept these terms. Keep your password safe and do not give other people access to your profile — you are responsible for what is done from it. You can delete your profile at any time under “Profile” → “Delete profile”.
Comments, your public name and everything you write in your profile must follow these rules:
- no insults, threats, harassment, hate speech or discrimination;
- no spam, advertising or links;
- no other people's personal data and no content of others that you have no right to share;
- no pretending to be someone else;
- no unlawful, indecent or misleading content.
Before it is published, a comment is checked automatically for links, and we review inappropriate words ourselves. Any comment can be reported. We may delete a comment that breaks the rules and, for repeated or serious breaches, block comments from the profile, suspend signing in to it or delete it. What we keep and for how long is in the Privacy policy: paliva.org/privacy.
Rights in the site's content
The songs, poems, texts, recordings, images, logo and design of the site belong to Paliva and are protected by copyright law. You may listen to them, read them and share links to them. Without our written consent you may not copy, download, re-upload, change or use them commercially. For a licence to use a song, write to us via paliva.org/contact.
The embedded videos come from YouTube and are shown under its terms.
How the contract is made
An order goes through these steps:
- You send an order through the form on the site. This is a request — it does not commit you to anything, including payment.
- We review the order and email you an offer: what we will create, the price, the delivery time, what you receive and the terms. If something is unclear, we ask you first.
- You accept the offer by replying to the email — “I confirm” is enough. By confirming, you expressly agree that we start work right after payment and acknowledge that you then lose the right of withdrawal (see “Cancellation and refunds”).
- We send you the payment details. The contract is made when the amount reaches our account — that is when we start work.
We may decline an order without having to give a reason — for example if its content breaks these terms or we cannot complete it in time. If we decline after payment, we refund the full amount.
The contract is made in Bulgarian or English — the language of the offer. It consists of the offer, your reply and these terms as they stand on the day you confirm. Keep the emails; we will send you a copy if you need one.
Prices and payment
- Prices are in euros and are final — no fees are added. The main prices, the prices by occasion and the express option are on paliva.org/prices; the prices there are “from” prices.
- Before you send an order, the form shows its amount — with the promotion, the discount code and the express option, if any. The final price is the one in the offer; if it differs from the amount shown in the form, we explain why and you decide whether to accept it.
- Promotions apply for the stated period and to the stated kinds of pieces and occasions. Discount and gift codes apply under the conditions they were issued with (period, number of uses, kind of order; personal codes only with the email they were issued for) and cannot be exchanged for money. Whether a code can be combined with a promotion is shown in the form when you enter it.
- The express option costs an extra fee, has a shorter delivery time and is offered only for some kinds of pieces and occasions.
- Payment is made in full in advance, by bank transfer to the account we send you after you confirm the offer.
Delivery times
There are two kinds of delivery times:
- standard — those stated on paliva.org/prices and on the order pages, including the shorter time for an express order;
- individual — agreed in the offer depending on how complex the order is and other circumstances (for example the length of the text or our workload). The time in the offer takes precedence over the standard one.
The time runs from the day the payment reaches our account until we send the first version for review. Time spent waiting for your reply (approval, comments or information we need) is not counted.
If we see that we will not meet the deadline, we will tell you straight away and agree a new one with you. Your statutory rights in case of delay are not affected.
Delivery
The piece is delivered in digital form. What exactly you receive (for example the song as MP3, and as WAV on request, the lyrics and the separate intro; the poem as text and as a PDF) is stated in the offer.
You receive the files by email or through a personal link to a page on the site. The link is personal: do not publish it and share it only with the people the piece is for.
- A personal link stays active for up to 2 years; Paliva sets the exact period for each link. If the piece has a video on YouTube, the link may lead to it.
- The personal card for the person who receives the piece as a gift stays active for up to 6 months. For a song order it is included in the price.
- We may deactivate a link before the end of its period in case of abuse — for example if it is published openly.
Download and keep your files — once the period ends, the link stops working.
Versions and revisions
Before the final version, we send you a version for review. Review versions of songs may contain a voice tag; they are only for approval — do not publish or share them and do not use them as the finished piece. The final file has no tag.
You can approve the version, ask for changes or decline — by replying to the email or from your profile. What is included depends on the kind of piece:
Songs
Songs are made with meaning and lasting value. People's names stay out of the lyrics — they may appear only in the separate intro. One revision is included when the song meets all the given criteria. If the style or a key parameter does not match the request at all, a new version is made until it does.
Poems
The poetry honours the poetic rhythm, mood, and memories or motifs you share. One revision for fine edits to the text is included. If a key requested motif or mood is missing, the poetry is reworked to reflect your story.
The piece is an original work: we follow your story and wishes, but the choice of words, melody, arrangement and performance is Paliva's. A different taste about a wish that has been fulfilled is not a defect of the piece. Changes beyond the included revisions — for example a new idea or a different story — are not part of the order and may be agreed separately.
Content from the client and from third parties
In the order form you send us the story about the person or the occasion, sometimes your own lyrics, the personal intro with names, music wishes (sometimes naming artists or songs), a message and the recipient's name and the occasion. These texts often contain data about other people — family, friends, children, people who have passed away — and sometimes works of others: a poem, an excerpt or the lyrics of an existing song.
Only we read the order, and we use it to write the lyrics and the music. We keep it for up to 2 years (or delete it earlier if you ask), and after that only an anonymised record without names and texts remains. Details: paliva.org/privacy. People's names stay out of the song's lyrics — they appear only in the separate intro.
The following rules apply to the content you send us:
- Rights and lawfulness. By sending content you confirm that it is yours or that you have the right to use it and give it to us, and that it is lawful: no defamation, insults, hate speech, other people's personal data that you have no right to share, or other prohibited content.
- Your own lyrics. We accept lyrics you send us, including the lyrics of someone else's existing song. We may check whether they are the lyrics of an existing song, but the check is not a guarantee. You are responsible for having the right to use them and for using them lawfully. A piece based on lyrics not written by Paliva is only for your personal use: it is not used commercially (neither by you nor by Paliva), not distributed and not uploaded to streaming or video platforms, and Paliva does not publish it.
- Music wishes. Artists and songs you name are only guidance on the style. We do not copy the melody or lyrics of another work.
- Other people's personal data. Share only what you have the right to share and what the order needs. When the piece is a gift, the recipient knows, or may learn from you, that you gave us their data. Take special care with data about children, about health and about people who have passed away — give it only if it matters for the story. We use this data only to create and deliver the piece and keep it for up to 2 years.
- Our right to use the content. You give Paliva a non-exclusive right, at no extra charge, to use the content you send only to create and deliver the piece and — if you agreed — to publish it. The rights in your own lyrics stay yours. What you may do with the finished piece is set out in “Rights in the piece and personal use”.
- Declining, changing, taking down. We may decline an order, change or leave out part of the content or stop work if it breaks these terms or the law, and take down a published piece after a well-founded report from a third party.
- Responsibility. If a third party makes a claim because of content you sent us (for example lyrics or data you had no right to give us), you are responsible for that claim to the extent the law allows.
- Reports. If you hold rights in content in a piece or on the site, or you are mentioned in it, and believe your rights are infringed, write to info@paliva.org: which content it is (with a link, if there is one), what the infringement is and how we can reach you. We will review the report and, if it is well-founded, remove or change the content and let you know.
- Comments and profile. The same rules apply to comments, your public name and everything you write in your profile.
Ordering a piece as a gift
- The party to the contract is the client — the person who orders and pays. The recipient is not a party to the contract.
- The client approves the versions, asks for revisions and decides when the piece is delivered.
- By giving us the recipient's name or contact details and asking us to send the piece to them, you confirm that you have the right to do so.
- Any refund goes to the client.
- The right of personal use covers both the client and the recipient.
- The personal card for the recipient stays active for up to 6 months.
How we create the piece (artificial intelligence)
- The words of the songs and poems are written by Paliva or given by you. Poems are not generated with artificial intelligence.
- The music and vocals of the songs are created with the help of artificial intelligence (AI) tools — from third parties, on a paid subscription that allows commercial use. Paliva directs the creative process: it chooses the style, the sound and the vocal, and selects and edits the versions before sending them to you.
- The vocal is synthesised. We do not imitate the voice of real performers and do not use other people's recordings or voices without the right to do so.
- Music created with AI may resemble other works in the same genre, and the tool may create a similar melody for its other users. We therefore do not guarantee that the melody is one of a kind; the words are written for your order only.
- We enter the song's words and style directions into the tool. For a personal intro we also enter the intro text with the name you gave us. We do not enter your email, phone number or your story as you told it. Details are in the Privacy Policy (paliva.org/privacy).
- Copyright protects human creativity. The rights in words written by Paliva belong to Paliva. For music and vocals created with AI, the law may not recognise copyright; Paliva holds the rights that the tool's terms give it and grants them to you within the scope of the section “Rights in the piece and personal use”.
Rights in the piece and personal use
Paliva is the author of the piece's words and keeps the copyright in them; in the music and vocals created with artificial intelligence, Paliva holds the rights that the terms of the tool used give it (section “How we create the piece”). The rights in your own lyrics stay yours. After full payment you receive a non-exclusive, perpetual, non-transferable right to use the piece personally and non-commercially:
- to listen to it, read it and give it as a gift;
- to play it at personal and family events;
- to use it in personal and family videos;
- to share it on your personal social media profiles, without earning from it;
- if Paliva has published it on its YouTube channel — to use it from there as well: to watch, share and embed it with YouTube's own features, on the same personal-use terms.
You receive the piece for personal use, not commercial use. The commercial rights stay with Paliva — also when the piece is published on Paliva's channel. Publishing depends on your consent and on Paliva's judgement of whether the piece is suitable; it does not give you any rights beyond personal use.
Without a separate licence you may not use the piece commercially (advertising, sales, paid events, monetised content), upload it to music streaming platforms, register it as your own (including in content recognition systems), adapt it or give it to others for such use. For a commercial licence, write to us via paliva.org/contact — we consider each request separately and, if we accept it, agree its scope and price in writing.
For a business order, use for the company (for example at an event, in greetings or in internal channels) is agreed in the offer and applies within the scope described there.
A piece based on your own lyrics or on the lyrics of someone else's song is for personal use only: it is not distributed or uploaded to streaming or video platforms, and no licence for commercial use is granted.
Publishing
Paliva publishes only pieces whose lyrics or text Paliva wrote, and only with your consent from the order form — on Paliva's YouTube channel and on paliva.org, and it may also share them on Paliva's Facebook page. The piece is marked as created on request, without your name — unless you explicitly ask for it. Consent does not oblige Paliva to publish — Paliva decides whether the piece is suitable and when to publish it. Without consent, the piece is not published. A piece based on your own lyrics or on the lyrics of someone else's song is never published or used commercially.
You can withdraw your consent to publishing at any time by emailing info@paliva.org — we then remove the piece from the site and from Paliva's channels. Withdrawal does not affect anything done before it.
Cancellation and refunds
The pieces are created from your story and wishes — they are made to order, personalised and delivered as digital content. That is why the 14-day right of withdrawal from a distance contract does not apply (Art. 57, items 3 and 13 of the Bulgarian Consumer Protection Act).
You can cancel the order:
- before you have paid — with no obligation at all;
- after payment but before we have started work — we refund the full amount;
- after we have started work — the amount paid is not refunded.
To cancel, write to us at info@paliva.org or reply to the offer. We refund the amount to the account it was paid from. Your rights if the piece is defective (section “Conformity and complaints”) are not affected.
Conformity and complaints
We are responsible for the piece matching what was agreed in the offer and in these terms. If something is wrong — for example a file does not open, part of what was agreed is missing or the piece does not meet the criteria given in the order — write to us at info@paliva.org with the order number and a short description.
We will reply as soon as possible. If the complaint is justified, we will fix or resend the file or make a new version at no extra cost; if that is not possible, we will reduce the price or refund the amount.
Artistic choices within the order (see “Versions and revisions”) are not a lack of conformity.
Liability
Paliva's liability for an order is limited to the price paid for that order. This limit does not apply where the law does not allow liability to be limited — in cases of intent or gross negligence, harm to life or health, and your statutory rights as a consumer.
To the extent the law allows, we are not liable for use of the piece in breach of these terms, for content you sent us (see “Content from the client and from third parties”), for interruptions of the site beyond our control, or for third-party services such as YouTube.
Personal data
How we collect, keep and use your personal data is described in the Privacy policy: paliva.org/privacy.
Disputes and governing law
If you are not satisfied, please write to us first at info@paliva.org — we will look for a solution together.
As a consumer you can file a complaint with the Bulgarian Commission for Consumer Protection (CPC) and turn to its conciliation committees for out-of-court dispute resolution: www.kzp.bg.
The contract is governed by Bulgarian law. Disputes that are not settled by agreement are decided by the competent Bulgarian court. This does not deprive you of the protection given to you as a consumer by the mandatory rules of the country where you live.
Changes and language
We may change these terms — for example when we add services or the law changes. The date of the last change is shown at the top of the page. An order is governed by the terms in force on the day you confirmed the offer. For your profile and comments the current text applies; if you do not agree with a change, you can delete your profile.
These terms are available in Bulgarian and English. If the two differ, the Bulgarian text prevails.
